Idaho Falls, Idaho – On April 19, 2016, Target, the second largest department store retailer in the United States, changed its store policy to permit people to use fitting rooms and restrooms based on the gender role they identify with, as opposed to biological sex.

Less than a month later, a man who perceives of himself as a transgender woman entered a fitting room in a Target store in Idaho Falls and used an iPhone to record the 18-year-old girl who was changing into a swimsuit in the stall beside the one that he was occupying.

That man was 43-year-old Shauna Patricia Smith, who was born male, and was originally named Sean Patrick Smith.

After his arrest for voyeurism, 43-year-old Shauna admitted to having made other videos of women undressing without their knowledge or consent. Prosecutors discovered video on Shauna’s phone of women and a possible underage girl undressing. Shauna confessed to having recorded these voyeuristic videos for “the same reason men go online to look at pornography.”

Shauna’s teen victim said in her Victim Impact Statement that she felt dirty, humiliated and “emotionally mutilated” by his voyeuristic intrusion on her privacy, and has suffered anxiety as a result. At the time of the incident, “I started to sob inside the dressing room. I was hyperventilating and scared,” she said. “I’ve always supported the transgender community, but felt betrayed. I have yet to go to a Target again, and haven’t been inside any public restrooms or dressing rooms.”

Shauna pleaded guilty and was sentenced to five years in prison, with the possibility of parole after two years. He must also paid for a year of the victim’s counseling.

Target said in a statement that it is committed to “creating a safe and secure shopping environment.”
