Woodburn, Oregon, US – The parents of an eight-year-old boy are suing the Woodburn School District for almost a million dollars because a teacher held their son back from recess multiple times for one-on-one conversations about his gender identity, without the parents’ knowledge.
The student’s parents had arranged with Nellie Muir Elementary School for their son to use the staff restroom because of a digestive-related medical condition. The parents allege that after noticing their son using the staff washroom, the teacher assumed the boy was not comfortable using the public boys’ restroom because he is transgender.
In April 2018, the teacher kept the boy inside the classroom alone during recess multiple times to teach him “it is acceptable to become transgender”, according to the lawsuit.
Based on recommendations from an “unknown non-school employee transgender individual”, the teacher developed lesson plans which included episodes of “I Am Jazz” (a reality series about Jazz Jennings, a male who identifies as a girl), the books “I Am Jazz” (based on Jazz Jennings) and “Who are You? The Kid’s Guide to Gender Identity”. The lessons also incorporated discussions on the difference between male and female body parts.
The parents became aware of the teacher’s actions when she told the boy to take the books home and share them with his family. When the parents complained to the school, they were told that “if this happened in Portland, it would not be a big deal.”
According to the lawsuit, the boy became confused about whether he was going to turn into a girl, and is now reluctant to play with “girl” toys or “girl-related” games. He has become more depressed, aggressive, isolated, and fearful of attending his current school, seeing the teacher and using the boys’ restroom. He is now taking anxiety medication and attending counseling. Additionally, the parents indicate they also struggle with anxiety, stress and depression, and the mother is currently on medical leave.
The lawsuit accuses the school of false imprisonment, negligence and the intentional infliction of emotional distress. The parents are asking for $79,999 for current and future counseling, medication, doctors’ appointments and therapy, along with $920,000 in non-economic damages.
